Dear Clients and Friends,
The purpose of this bulletin is to inform you about the payment of the Christmas bonus that shall be made to employees during this season, as foreseen in Article 87 of the Federal Labor Law (Ley Federal de Trabajo). This bonus shall be paid before the 20th of December of the current year.
Employees entitled to this benefit include: regular, trusted, permanent, unionized, those hired for a specific project or period, temporary, commissioned, commercial agents, insurance agents, salespersons, and other similar employees governed by the Federal Labor Law.
It is important to note that the payment of this benefit cannot be made in kind of vouchers, or tokens; it must be made in cash, through bank deposit, or transfer.
The payment shall be at least equivalent to 15 days’ salary, depending on the internal policies of each company.
Employees who have not completed a year of service within the company, those hired for a specific project or period, or temporary employees—regardless of whether they are currently working or did so at the beginning of the year—also have the right to claim this benefit. They can do so either at the time of termination or during these dates if it was not covered at the appropriate time. The proportional portion will be paid based on the days worked.
It should be noted that failure to comply with this obligation as an employer, or incorrect or delayed compliance, may result in a fine as foreseen in the Federal Labor Law.
