This bulletin pretends to inform about this norm on Telecommuting (home office) published on June 8, 2023 by the Secretary of Labor and social welfare in the Official Journal of the Federation, which will enter force on December 5 of the current year.
NOM-037-STPS-2023 establishes the health and safety conditions in which telecommuting must be carried out in work areas throughout the Mexican Republic to prevent accidents and illnesses, as well as promote a safe and healthy environment in the work environment. intended for this modality.
Companies that have workers in this modality (Telecommuting) will have the following obligations:
- Have an updated list of the workers doing telecommuting.
- Workplaces for this modality must have connectivity for the use and management of information and communication technologies, among others.
- A telecommuting policy must be established that complies with the disposed regulations of internal work, among other provisions.
- Inform workers about the risks related to telecommuting.
- Provisions established by the Safety and Hygiene Commission must be provided.
- To guarantee safety and health conditions, the employer may be able to visit the place, with the prior authorization of the employee.
- The telecommuting implementation process must be documented.
- They must provide workers the tools for the job.
- They will need to provide training for this type of job.
- Medical examination must be carried out on workers in this modality and among other procedures.
- It´s worth mentioning that the norm establishes mechanisms of protection for the people who suffer violence at home and for lactating women, among others.
It´s important to mention that the information provided it is merely informative, since said labor norm is more extensive and has higher requirements that those mentioned before.
