Yesterday, the Ministry of Labor and Social Security (Secretaría del Trabajo y Previsión Social “STPS”) issued a press release number 105/2021, whereby it announces the beginning of the “Compliance Inspection Phase of the Registry of Specialized Service Providers and Works (“REPSE”)”, under the following guidelines and provisions:
No mass inspections will be carried out, only strategic inspections in those cases where data analysis and complaints reveal serious concerns.
The foregoing statement urges employers to comply with the law, and highlights that all companies that have not complied with all of the requirements set forth in the REPSE platform must comply with the new provisions.
The STPS will begin with the compliance inspection stage for companies that have completed their registration as providers of specialized services and works (REPSE), informed the head of the dignified work unit, Alejandro Salafranca Vázquez.
During the virtual seminar “Understanding the Labor Amendment”, How are we doing? Salafranca Vázquez pointed out that this new stage does not imply the performance of massive inspections, but rather strategic inspections in those registries that according to the data analysis are seen as non-compliant companies, highlighting that around 70% of the information that the companies provided in the REPSE registration process are self-declared, in good faith and from this date on, the aim is to confirm if the information provided is true, that the addresses of the work centers exist and that the company is operating according to the activity they declared.
The authority calls upon businessmen who have complied with the law to remain calm and provides observation measures and consequently sanctions to all those companies that, on the contrary, have not complied with the law.
Last September 1st was the date on which the transitional period to register before the REPSE concluded and to continue enjoying its tax benefits, a period in which 71 thousand companies concluded their registration process on the platform, showing that 93% received a response, 88% of which were positive and the remaining 12% negative, highlighting that the companies informed of their non-approval, were given the opportunity to complete the process again.
