On March 15, 2023, the Senate of the Mexican Republic unanimously approved with 88 votes in favor, the Draft Decree that adds section XV Bis to article 132 and section I Bis to article 133 of the Federal Labor Law (LFT), regarding labor rights for senior citizens.
This proposal arises from the law initiative issued by the Congress of the State of Baja California, and is motivated by the need of the population of adults over 60 years of age to continue working in a productive environment, due to their labor trajectory and/or precarious retirement system that prevails in Mexico, aiming for a dignified old age.
The purpose of the proposal is to recognize the importance of this group of more than 17 million people in Mexico in order to have access to a decent life and in view of the lack of pensions and job opportunities, which forces them to accept low-wage and/or informal jobs.
Employers are required to hire a minimum of 5% of positions occupied by adults over 60 years of age and in employment sources with more than 20 workers.
