This newsletter aims to raise awareness about the work of women, who enjoy the same rights and have the same obligations as men, with the fundamental purpose of protecting maternity.
When the woman’s health is endangered, or that of the offspring, either during pregnancy or breastfeeding, without affecting her salary, benefits and rights, she may not be involved in unhealthy or dangerous work, industrial night shifts, in commercial or service establishments after ten o’clock at night, as well as overtime work.
Hazardous or unhealthy work is defined as work that, due to the nature of the work, the physical, chemical and biological conditions of the environment in which it is performed, or the composition of the raw materials used, is capable of affecting the life and physical and mental health of the pregnant woman or her child.
Working moms shall have the rights listed below:
- During the period of pregnancy, they shall not perform work that requires considerable effort and represents a danger to their health in relation to pregnancy.
- They will enjoy a six-week break before and six weeks after delivery.
- In the event of adoption of an infant, they shall enjoy a six-week paid leave.
- During the breastfeeding period, up to a maximum term of six months, they will have two extraordinary breaks per day, of half an hour each, to feed their children, in a suitable and hygienic place designated by the company, or, when this is not possible, upon agreement with the employer, their workday will be reduced by one hour during the aforementioned period.
- To return to the position they held, provided that no more than one year has elapsed since the date of delivery; and
- To have the pre- and post-natal periods considered in their seniority
