On June 4th this year, an executive order was published on the Federal Official Gazette, regarding the addition of provisions on the Social Security Law (LSS), the Security and Social Services Institute for State Employees, and in the Federal Labor Law (LFT), which will come into force as of June 5th.
The aforementioned, establishes on article 140 Bis of the LSS that insured working mothers or fathers, whose children under 16 years have been diagnosed with any kind of cancer by the Mexican Social Security Institute (IMSS), will be granted a license to attend their child’s medical care, and to miss their work if their diagnosed child requires medical rest during major hospitalization periods or during medical treatment, pursuant the prescription of the treating doctor, including, if the case may be, pain relief treatments and palliative care for advanced cancer.
The IMSS may issue a certificate stating the oncological condition and the duration of the treatment, for either one of the working insured parents, thus their employer is aware of such license.
